In which case it would be justifiable to effect recovery of dues from a Govt. servant at a rate exceeding 1/3 rd of his pay ?

where the Govt. servant has taken an advance for a specific purpose but not utilised it for the purpose and failed to refund it within the period stipulated

in cases where his drawing and disbursing officer applies his discretion to effect recovery at a higher rate

in a situation where unless recovery is made at a higher rate, it will not be possible to complete it before retirement

in no case it should exceed 1/3 rd of his pay
